Most employees are lucky enough not to experience their employer experiencing financial difficulties. However when they do, the employees experience significant uncertainty as well as the financial distress caused by non-payment of wages or the failure of a pension scheme.

In addition in formal insolvency procedures such as liquidation we may be able to act as Insolvency Practitioner if you are unhappy with the liquidator proposed.

Fees

If acting in a formal Insolvency Practitioner capacity our fees will normally be covered by the assets of the business and as such there will be no direct cost to the employees concerned. When representing groups of employees in other capacity we agree the quantum and basis of fees in advance and normally find that the cost per employee is actually quite low.

What we do differently

We understand the impact upon employees of a struggling business and try to minimise the impact and uncertainty. In particular where we act as Insolvency Practitioner we:

Provide information about employee rights upon the employer's insolvency;
Forms required to claim redundancy, arrears, etc. are normally completed for the employee;
We will calculate what we think you are entitled to and show you how to claim it and the amount you are likely to receive and when; and
We will keep you fully informed as to the progress of the matter and implications upon the employees.
